By purchasing services from Nayu Media, submitting payment, signing a proposal, or otherwise engaging our services, the Client ("Client," "you," or "your") agrees to these Terms & Conditions.
Nayu Media provides digital services including but not limited to website design and development, website maintenance, SEO services, funnel development, paid advertising, marketing strategy, CRM and automation setup, AI chatbots, AI receptionists, consulting services, and related digital marketing services. Specific deliverables will be outlined in the Client's Proposal, Invoice, Project Summary, or Scope of Work.
A project is considered approved once full payment is received, a deposit is received (if applicable), or written approval is provided by the Client. Upon approval, project scheduling and production may begin.
Projects Under $5,000 — Unless otherwise agreed in writing, projects under $5,000 require payment in full before work begins.
Projects Over $5,000 — Projects exceeding $5,000 may qualify for a payment plan requiring a minimum 50% deposit. Any alternative payment arrangement must be agreed upon in writing. Failure to make scheduled payments may result in project suspension.
Prior to Work Beginning — If a project has not started, Nayu Media may issue a refund at its sole discretion.
After Work Has Begun — Once work has started, payments become non-refundable due to time, labor, planning, strategy, design, and development costs already incurred, including discovery, planning, strategy, design, development, revisions, and consultation.
The Client agrees to provide all requested materials necessary to complete the project, which may include logos, brand assets, images, videos, service information, product information, pricing, testimonials, copywriting, event information, and social media links. The Client is responsible for ensuring all materials submitted are accurate and legally owned or licensed.
Unless specifically included in writing, the Client is responsible for providing website content such as homepage content, about content, service descriptions, product descriptions, event descriptions, pricing information, and FAQs. Nayu Media may edit content for clarity, formatting, grammar, and user experience purposes.
Starter website projects are typically completed within 2-4 weeks. Larger custom projects may require additional time depending on complexity. Project timelines depend upon timely communication, asset delivery, Client approvals, and third-party systems, and may be extended if required materials are delayed.
Clients are expected to provide requested assets and information within ten (10) business days of request. Projects inactive for thirty (30) consecutive days due to missing client materials may be placed on hold. Projects inactive for more than sixty (60) days may be closed. A Project Reactivation Fee may apply before work resumes.
Current Reactivation Fee: $250
Starter website projects include one (1) design revision round and one (1) content revision round. A revision round consists of one organized submission of requested changes. Design revisions include images, colors, layout adjustments, and section placement; content revisions include text updates, pricing updates, and information corrections. Additional revisions may incur additional fees.
Any request outside the originally approved scope is considered additional work — for example, additional pages, new features, e-commerce functionality, membership systems, additional integrations, or new design concepts. Additional work requires a separate quote, written approval, and additional payment.
Upon full payment, the Client receives ownership of the final website content and assets provided specifically for their project. Nayu Media retains ownership of its design processes, frameworks, layout methodologies, internal systems, templates, and reusable design structures, and reserves the right to reuse general layouts, frameworks, workflows, and design concepts for future projects, as well as to maintain backup copies of completed projects for portfolio, archival, and recovery purposes.
Unless otherwise agreed in writing, Nayu Media may display completed work in portfolio materials, marketing materials, social media, and case studies.
Nayu Media is not responsible for outages, pricing changes, policy changes, or performance issues related to third-party providers including but not limited to Wix, Stripe, PayPal, Google, Meta, YouTube, and domain providers.
Website projects include seven (7) days of complimentary post-launch support, covering technical troubleshooting, functionality verification, and launch assistance. This does not include new pages, new features, redesign requests, or additional development.
Maintenance services are optional and provided under a separate maintenance agreement. Maintenance is not included unless specifically purchased.
Nayu Media shall not be liable for indirect, incidental, special, or consequential damages arising from the use of services provided. Maximum liability shall not exceed the total amount paid by the Client for the specific project.
Both parties agree to first attempt to resolve disputes through good-faith communication and mediation before pursuing legal action.
These Terms & Conditions shall be governed by the laws of the State of Alabama.
Nayu Media reserves the right to update these Terms & Conditions at any time. The most current version will always be available on the Nayu Media website.
From time to time, Nayu Media may run limited promotional offers. The following terms apply to our current promotion:
$500 48-Hour Website Special — This promotional offer provides a professional three-page website (Home, Services, and Booking) with built-in online booking, mobile optimization, the client's own colors, photos, and brand, one (1) round of revision, and delivery within 48 hours of receiving all required materials and payment. A basic logo is provided unless the client supplies their own branding or images.
Eligibility — This offer is available to beauty professionals only (including but not limited to nail technicians, lash artists, estheticians, threading studios, makeup artists, wax specialists, and hair professionals) and to new clients only. It is available exclusively to those who arrive through our Instagram promotion.
Pricing — The $500 figure is a starting price. Additional pages, features, or add-ons may increase the total, which will be confirmed before work begins.
Conditions — Payment is required in full and upfront before work begins. Promotional slots are limited and offered on a first-come, first-served basis. This promotion runs through the end of July and may be modified or withdrawn at any time. The 48-hour delivery window begins once the client has submitted all required materials and completed payment. All other Terms & Conditions, including the Refund Policy, apply to this promotion.
